CineGrid Terms and Conditions

1. Introduction and Acceptance of the Terms

Please read these terms carefully as they contain important information regarding your legal rights, remedies, and obligations.

The CineGrid community is built on trust and respect among filmmakers, cinematographers, and content creators. Disputes are very rare in the community, but if there are any issues, we will always do our best to help our members resolve them quickly and fairly.

CineGrid is an online marketplace platform managed and operated by Antler Production Pvt. Ltd. (VAT No. 621136065) (hereinafter referred to as "CineGrid", "Company", "we", "our", or "us"). CineGrid.net is an online platform that facilitates the listing and rental or purchase of cinema and film production equipment (including but not limited to cameras, lenses, lighting equipment, audio equipment, grip and electric gear, post-production hardware, drones, and other filmmaking equipment), production locations, and related services (collectively, hereinafter, "Listing" or "Listings").

The following terms and conditions, together with any documents they expressly incorporate by reference govern each user's (hereinafter, "you," "your," "Member," or "User") access to and use of the CineGrid website, including any subdomains thereof, and any other websites through which CineGrid makes the CineGrid website available (collectively, "Site"), any mobile applications and application interfaces (collectively, "Application"), and all associated services offered on or through CineGrid.net or by CineGrid (hereinafter collectively, the "CineGrid Services"), whether as a guest or registered User.

By accessing or using the Platform, you agree to comply with these Terms of Service, whether or not you become a registered User.

2. Modifications to the Terms

We reserve the right to modify the Platform or revise and update the Terms from time to time, at our sole discretion. If we modify the Terms, we will update the "Last Modified" date and send an email notification to Users.

By continuing to access or use our Platform after we have posted a modification, you are indicating that you agree to be bound by the modified Terms.

3. General Terms and Conditions

Eligibility to Use CineGrid Platform:

The Platform is offered and available to Users who are eighteen (18) years of age or older who can form legally binding contracts. By using the Platform, you represent and warrant that:

  • • You are at least eighteen (18) years old
  • • You can form a binding contract with CineGrid and other Users
  • • You submitted accurate and truthful account information
  • • You meet all eligibility requirements

CineGrid Account Registration:

To access certain features of the Platform, including listing, requesting, renting, or purchasing equipment, you must register to create a CineGrid account. You may not assign or transfer your CineGrid Account to another party, and you may not register more than one account unless authorized by CineGrid.

4. Transaction Charges and Payment Processing

Once a Renter agrees to rent equipment or a Buyer agrees to purchase equipment on CineGrid, we process payment and remit funds to the Owner or Seller. We use third-party payment providers including Braintree, Stripe, and Plaid to process transactions.

By providing payment credentials, you authorize CineGrid and our payment processors to store your payment information for future transactions and charges for any unpaid balances.

5. Listings and Equipment Conditions

Owners and Sellers are responsible for creating accurate Listings that properly describe cinema/film equipment. All photos must accurately represent the equipment being offered.

Replacement Value:

Owners must set an accurate market value for their equipment ("Replacement Value"). This value is displayed publicly and represents the maximum amount owed for repair or replacement of damaged equipment.

6. Insurance and Loss Damage Waiver

Disclaimer: CineGrid is not an insurance provider, broker, or agent. Our loss damage waiver coverage options are not insurance policies.

Renters may purchase optional loss damage waiver coverage to protect against damage or theft of rented equipment. Coverage options include Damage Only Coverage and Damage + Theft Coverage.

7. Order Management and Administrative Oversight

Order Transparency: CineGrid provides administrative oversight of orders to ensure platform integrity, protect users, and maintain service quality.

Administrative Order Review

CineGrid administrators reserve the right to review, accept, or reject orders on behalf of vendors in the following circumstances:

  • • Quality Assurance: To ensure orders meet platform standards and vendor requirements
  • • Fraud Prevention: To detect and prevent fraudulent transactions or suspicious activity
  • • Dispute Resolution: To mediate conflicts between buyers and vendors
  • • Compliance: To ensure orders comply with applicable laws, regulations, and platform policies
  • • Vendor Protection: To protect vendors from potentially problematic transactions
  • • Service Optimization: To improve overall platform experience and service delivery

Order Acceptance and Rejection

When an administrator accepts or rejects an order on behalf of a vendor:

  • • All parties (buyer, vendor, and administrator) will be notified of the decision
  • • The decision will be documented in the order history
  • • Vendors maintain the right to appeal administrative decisions through our support system
  • • Buyers will receive appropriate refunds or order modifications as applicable

Vendor Responsibilities

Vendors acknowledge and agree that:

  • • Administrative oversight is part of the platform's standard operations
  • • CineGrid administrators may act on their behalf to maintain platform integrity
  • • They will be notified of any administrative actions taken on their orders
  • • They should maintain accurate listings and respond promptly to order inquiries
Important: While administrators may review and make decisions on orders, vendors are ultimately responsible for fulfilling accepted orders according to the terms agreed upon. Administrative oversight does not relieve vendors of their contractual obligations to buyers.

8. KYC Verification and Device Permissions

KYC & Identity Verification

To use certain features of the Platform, including vendor registration, account verification, and rental services, you may be required to complete Know Your Customer (KYC) verification. This process is required for compliance, fraud prevention, and risk management.

KYC Requirements: The KYC verification process collects and processes:
  • • Uploaded KYC documents
  • • Government-issued ID images
  • • Selfie images for identity verification
  • • Live face verification data (liveness detection)
  • • Verification status and audit logs

Camera Access for KYC Verification

Camera access is required to facilitate KYC verification processes. This allows you to:

  • • Capture photos of government-issued identification documents
  • • Take selfies for identity verification
  • • Upload verification documents directly from your device
Important: Camera access is only requested when you initiate the KYC verification process. We do not access your camera without your explicit permission, and all captured images are securely transmitted and stored for verification purposes only.

Location Access for KYC Verification

Location access may be requested to verify your location as part of identity verification requirements during the KYC process.

By requesting KYC verification, you grant CineGrid permission to access your device's camera and location services for verification purposes. You may revoke these permissions at any time through your device settings, though this may limit your ability to complete verification or use certain platform features.

Location Tracking for Rental Services

When you rent equipment through CineGrid, you agree to location tracking during the rental period. To protect asset security and operational integrity, we track location data during active rental periods for:

  • • Theft prevention
  • • Recovery of lost equipment
  • • Insurance claim validation
  • • Delivery optimization
  • • Return verification
  • • Dispute resolution and order verification
Automatic Disabling: Location tracking is active only during active rental periods and is automatically disabled once the rental period ends. We do not track your location when you are not actively using rental services.

By renting equipment, you consent to this location tracking as a condition of the rental agreement.

Your Rights: You have the right to refuse location tracking, but this may result in limitations on rental services or require additional security deposits or verification measures.

9. Advertisement Click Tracking and Curated Results

CineGrid uses cookies and tracking technologies to improve our advertising services and provide curated search results. By using the Platform, you acknowledge and agree that:

  • • Measure advertisement performance
  • • Analyze click behavior
  • • Improve search relevance
  • • Optimize curated results
  • • Enhance personalization
  • • Provide analytics to advertisers in aggregated, anonymized form
Cookie Preferences: Users may adjust cookie preferences via browser settings. However, disabling tracking may affect the relevance of search results and advertisements.

Curated Results

Our curated results feature uses your interaction data, click patterns, and preferences to:

  • • Show you more relevant listings
  • • Prioritize results based on your preferences and behavior
  • • Improve search accuracy over time
  • • Enhance your overall platform experience

Search results may be curated based on your interaction history, preferences, and click patterns. You can adjust search preferences in your account settings, though this may affect result relevance.

Consent: By using the Platform, you consent to click tracking and curated results as described in this section and our Privacy Policy. Click tracking data is collected through cookies, web beacons, and similar technologies and is aggregated and anonymized where possible.
